H-1Bs and Petitions for Workers

Here at the Law Firm of Moumita Rahman, we have successfully helped obtain hundreds of temporary worker visas in numerous different categories. These visas are considered “non-immigrant” visas because they are granted for a limited period of time, and are not permanent. Please read below for the main non-immigrant visa categories we have helped clients with:

  • H-1B Visa

An H-1B Visa is a visa for Specialty Occupation Workers In order to qualify as a specialty occupation, the position must require a body of specialized knowledge in addition to a Bachelor’s degree or the equivalent in that field. The government puts a cap on the amount of H-1B visas granted every year.

  • E-1 Treaty Trader Visa

The E-1 Visa is for Treaty Traders. A person may enter the United States temporarily using this visa in order to carry on trade between their home country and the U.S. if their home country has a treaty with the United States.

  • E-2 Treaty Investor Visa

The E-2 Visa is for Treaty Investors. A person may enter the United States using this visa in order to develop and direct the operations of an enterprise in which they have invested. Employees of Treaty Investors who perform duties that require special qualifications and are essential to the business may also obtain an E visa. These employees must have the same nationality as the alien employer and their home country must have a treaty with the United States.

  • L-1 Intracompany Transfer Visa

High level and essential employees of multinational companies may be eligible for L-1 visas if they are being transferred to the United States. In order to qualify for an L-1 visa the employee must have worked at the same employer in a managerial, executive, or specialized knowledge capacity within the last three years for a minimum of one year.

  • O-1 Extraordinary Ability (“Artist’s”) Visa

O-1 Visas are available to highly talented or acclaimed foreign nationals such as entertainers, scientists, businessmen, and athletes. A high level of achievement must be shown by qualifying for at least 3 out of a set of 10 standard criteria.

  • P Visa Athlete’s Visa

Internationally known athletes and entertainment groups may be eligible to come to the United States temporarily on a P visa. Performing artists that are part of a reciprocal exchange program are eligible for P-2 visas, and culturally unique entertainers are eligible for P-3 visas.

  • R-1 Religious Workers Visas

Religious workers may use an R-1 visa to come to the United States in order to participate in a religious occupation and perform services for their religious organization as long as the religious organization is already established in the United States.

  • TN Visa

The North American Free Trade Agreement (NAFTA) allows for citizens of Mexico and Canada to apply for a TN visa. In order to qualify for a TN visa, an applicant must be employed in one of the listed professions in NAFTA.

    If you take away one thing from this review it's this: HIRE MOUMITA FOR YOUR CASE! She is the best and truly deserves all the awards and commendations she's earned.

    I can't say enough positive things about my experience working with Moumita and her team during the process of applying for/obtaining my Green Card. They were always quick to respond to things, always let me know about new developments and how they might affect our case, and just generally guided us through the entire process with a steady hand that I will be eternally grateful for.

    Our case ended up having some unforeseen complications that I won't get into here (we personally believe it was due to a USCIS error), resulting in my wife and I having to do a Stokes interview. For those who are unaware, this happens if USCIS has any reason to believe something is up and will then conduct separate interviews of the beneficiary and petitioner to make sure things line up. We hadn't done anything wrong and getting this outcome from our first interview was emotionally devastating to my wife and me, but Moumita did an amazing job giving us perspective and calming us down. She was also absolutely incredible at helping us prepare for the second (Stokes) interview - which ultimately ended up being quite brief (but gave us a long, hilarious story to tell friends now that it's all behind us) because the agent saw that clearly everything was legitimate.

    The immigration process is, unfortunately, ridiculously complicated. While it's not impossible to go it alone, having a great attorney such as Moumita by your side certainly makes the whole process a LOT easier. She put in so much time and effort on our behalf and my wife and I came to genuinely think of her as a friend through the course of the process. We'd chit chat about our families and food while we waited for our USCIS appointments and she's just such a real, down-to-earth, compassionate person. You are not just a case number to her - Moumita actually treats you like a person whose worries and concerns really matter, a dignity that often isn't given to clients by much larger firms.

    If money is your concern, I can also tell you that a) her rates are far more reasonable than most other attorneys I looked at and the level of service provided is beyond excellent and probably worth 10x more than what she asks for, and b) it's 110% worth the investment because trying to do it on your own and potentially having to re-do the entire process due to some critical error she'd have foreseen will ultimately be WAY more expensive than hiring her and getting it right the first time.

    Hiring Moumita was the BEST decision I made in my immigration journey. For whatever my words are worth, just go for it and hire her. You won't regret it for a minute.

      Moumita is the best lawyer my wife and I could have asked for. Not only is she extremely nice, but also very diligent on her work. She assisted my wife and I on our Greencard application (marriage-based) and albeit long, the process was very smooth. She was available throughout the whole process and was with us for our interview. She was referred to me by a friend who also praised her and Nana for being amazing! Thank you Moumita and Nana!

      My husband and I will always be grateful for Moumita Rahman. We were overwhelmed with all the forms and paperwork that are required to claim your spouse for a residency and decided to hire an attorney which is also not an easy decision to make.

    Even thought these days these processes are taking so much longer than usual, Moumita and her assistant Violet made the entire waiting so much easier.

    We found Moumita thru Yelp based on her great reviews and we are so glad we made the choice to go with her. She was ultimate professional, very warm and caring. All of our questions and concerns were answered promptly, and she always made us feel at ease.

      Moumita is working on my immigration case and she's literally the best. I have recommended her to many of my friends. She responded every email on timely manner, she's there whenever I needed her, and I recently got hired by new employer but my green card expired already, she reviewed all I-9 rules carefully, made appointments for me to Uscis.
